Sophie Edlinger

Sophie Edlinger assists private and public entities (large companies, SMEs, local authorities, etc.) in identifying and managing various environmental and construction law issues, both in the context of consulting and litigation.

Education

Sophie Edlinger holds a Master's degree in public business law (2002), a DEA in Community law (2003), and a DEA in environmental law (2004).

Areas of practice

Her practice areas cover environmental law (law on classified facilities, waste law, polluted sites and soils, industrial risks, etc.) in public and private law.

She assists the firm's clients in establishing and securing their projects (creating a new industrial site, modifying the activities of an existing site, cessation of activity, rehabilitation). She further assists them in their relations with the authorities.

She defends the interests of the firm's clients, whether as plaintiff or defendant, before the competent courts, whether in litigation against the administration (e.g., challenges to prefectural decrees refusing to issue an authorization, formal notice decrees, etc.) or against third parties (e.g., litigation on the legality of operating licenses, actions for abnormal neighbourhood disturbances, etc.).

She has acquired special expertise in the management of polluted or potentially polluted sites and soils, especially in the context of sales of industrial sites or transfers of the companies operating them, both in terms of advice and litigation (audits, drafting of contractual clauses, litigation procedures in claim or defence, etc.).

She has also developed an expertise in construction law, both in public and private law issues.

Furthermore, she collaborates in drafting contracts between the client and the various parties involved (architect, general contractor, technical design office, contractor, AMO, MOD, etc.).

She assists the firm's clients in monitoring construction sites and the management of disputes between them and the other parties involved or third parties, regardless of the legal basis (legal guarantees for builders, damage insurance, all-risk construction insurance, contractual and extra-contractual civil liability, etc.).

She also acts more generally in public business law (public contracts and procurement, urban planning law, etc.), and in general administrative law.

In these various practice areas, Sophie Edlinger acts as counsel and in litigation before the administrative and judicial courts.

Publications

Sophie Edlinger is co-author of the Environmental Code (Ed. Lexis Nexis) and the Administrative Justice Code (Ed. Lexis Nexis) and is the author of comments in the environmental law case law column published in the Gazette du Palais.
