Public business law

The Public Business Law Department assists private economic operators and public decision-makers in the definition and execution of public initiative projects, both by advising them throughout those projects and by helping them in the event of litigation or the implementation of an alternative dispute resolution method.

The lawyers in the Public Business Law Department retain expertise’ in legal issues and operational and financial realities and are mainly involved in major infrastructure projects (real estate, transportation, energy, environment, communications, etc.).

Public procurement

Compliance with public contracting procedures is a growing challenge for both the public entities that initiate these projects and the companies wishing to become involved.

The skills of the Public Business Law Department are based on all the problems of public procurement to assist the parties involved in the design and execution of the various types of contracts that make up public procurement (contracts, concessions, public service delegations, complex contracts):

Analysis of the practicability of contractual arrangements and resulting procedures
Assistance in the tendering of public contracts
Assistance to economic operators in drafting responses to calls for tenders (draft contracts, hearings, etc.)
Follow-up of the execution of public contracts
Assistance in the negotiation, transaction, conciliation and arbitration phases
Litigation of the awarding and execution of public contracts (pre-contractual and contractual summary proceedings, actions for annulment, actions for damages, etc.)

The Public Business Law Department supports public and private bodies to provide expertise in the management of different types of public domains:

Assignment and decommissioning
Assignment and transfer of public property

Intercommunity

The Public Business Law Department assists local authorities in their structural organisation issues (SEM, SEMOP, EPCI, unions, associations, etc.) related to their governance and/or to realise public sphere projects.
